I. SCOPE 

This Privacy Policy applies to all personal data processing activities carried out by SPHERE IT CONSULTING S.A.C. (hereinafter “SPHERE“) with Tax ID (RUC) 20522364283. It will also apply to individuals or companies to whom SPHERE requires the processing of personal data for which it is responsible. 

The personal data processed includes full name, email address, company name, company address and tax identification number (RUC), and phone number. Additionally, when the nature of the request so requires, and insofar as it is strictly necessary, specific additional information may be required for the execution of SPHERE’s obligations. 

II. GENERAL INFORMATION 

SPHERE is a computer systems consulting company specialized in software development, IT projects, e-commerce platforms (Commerce – BigCommerce, Feedonomics, Makeswift), cloud data solutions (Snowflake Data Cloud), and business resource management and business process systems. 

As part of our activities, we process personal data in compliance with Law 29733, Personal Data Protection Law, its Regulation approved by Supreme Decree 003-2013-JUS, and its complementary and amending regulations (hereinafter defined as the “Personal Data Protection Regulations”), as well as the Information Security Directive issued by the competent authority. 

III. PURPOSE OF PERSONAL DATA PROCESSING 

SPHERE processes personal data of employees, suppliers, clients, and potential clients, and all individuals who have any legal or commercial relationship with our company, in order to comply with current legislation, execute the legal relationship that the data subjects maintain with our company, and safeguard the security of our clients and employees. 

Specific purposes of personal data processing include: 

  • Provision of IT consulting services, software development, Commerce and Snowflake platform implementation. 
  • Communication with clients and response to commercial inquiries. 
  • Billing and payment management. 
  • Sending information about new services, events, and relevant content (with prior consent). 
  • Compliance with legal, tax, and labor obligations. 
  • System security and fraud prevention. 

Processing of personal data for any other lawful purpose different from those mentioned above is duly informed to the data subjects, requiring their specific authorization. 

IV. INFORMATION COLLECTION

Information provided directly: 

  • Identification data: full name, identification document, date of birth. 
  • Contact information: email address, phone number, physical address. 
  • Business information: company name, tax ID, position, industry sector. 
  • Project information: technical and functional requirements, business objectives. 

Automatically collected information:

V. CONSENT 

SPHERE will require the free, prior, express, unequivocal, and informed consent of the data subject for processing their personal data, except in cases of exception expressly established by law. 

Completion of forms required by our web portal or mobile applications for access to services, advice, or event participation represents the express consent of the data subject for the collection of their personal data and for their processing for the specific purposes that motivated their collection. 

SPHERE will not require consent to process personal data obtained from publicly accessible sources, free or not; likewise, it may process personal data from non-public sources, provided that such sources have consent to process and transfer such personal data. 

VI. PERSONAL DATA TRANSFER 

In cases where the data subject has expressly authorized it, SPHERE may transfer personal data locally and internationally to companies Snowflake Inc. and BigCommerce Inc., Sphere’s business partners, to send advertising, commercial proposals, conduct surveys, event invitations, understand consumer preferences, prepare statistics and/or behavioral studies. 

Additionally, SPHERE may transfer personal data to: 

  • Technology service providers (hosting, data analysis, cloud platforms such as AWS, Google Cloud, Microsoft Azure). 
  • Authorized partners of Feedonomics and Makeswift for project implementation. 
  • Legally authorized public entities within their areas of competence, in compliance with current or future regulations, or upon their request (SUNAT, National Authority for Personal Data Protection, judicial authorities). 

International transfers: Some of our providers and partners may be located outside Peru, including the United States and other countries. We ensure that these transfers are made with adequate protection guarantees through standard contractual clauses or internationally recognized privacy certifications. 

VII. PERSONAL DATA RETENTION PERIOD 

Personal data necessary to fulfill the aforementioned purposes will be stored and processed by SPHERE until they are no longer necessary for the purposes for which they were collected and/or until the data subject revokes their consent or requests their deletion. 

Specific retention periods are: 

  • Contractual data: During the contract term and up to 10 years thereafter to comply with tax obligations in accordance with the Peruvian Tax Code. 
  • Marketing data: Until the data subject withdraws consent or requests deletion. 
  • Browsing data: Up to 24 months from the last website visit. 

Once retention periods expire, we will proceed to securely delete or anonymize personal data.

In compliance with current regulations, SPHERE adopts appropriate legal, organizational, and technical measures to ensure the security of personal data, preventing its alteration, loss, improper processing, or unauthorized access.

According to Law No. 29733, personal data subjects have the following rights:

  • Right of access: Know what personal data we store and how it is processed. 
  • Right of rectification: Request correction of inaccurate, incomplete, or outdated data. 
  • Right of deletion: Request deletion of your data when no longer necessary or when the purposes that motivated their collection have ceased. 
  • Right to object: Object to the processing of your data for direct marketing purposes or when there are well-founded reasons. 
  • Right to withdraw consent: Withdraw your consent at any time, without affecting the lawfulness of previous processing.
