I. SCOPE

This Privacy Policy applies to all personal data processing activities carried out by Sphere IT Consulting S.A.C. (hereinafter, “Sphere IT Consulting”), registered under RUC No. 20522364283. It also applies to any individuals or legal entities to whom Sphere IT Consulting entrusts the processing of personal data for which it is responsible.

The personal data subject to processing includes full name, email address, company name, company address, tax identification number (RUC), and phone number. Additionally, when the nature of the request requires it and to the extent strictly necessary, specific additional information may be requested to fulfill Sphere IT Consulting’s obligations.

II. GENERAL INFORMATION

Sphere IT Consulting is an IT consulting firm specializing in software development, IT projects, e-commerce platforms (Commerce – BigCommerce, Feedonomics, Makeswift), cloud data solutions (Snowflake Data Cloud), and enterprise resource planning and business process management systems. In the course of its activities, Sphere IT Consulting processes personal data in accordance with the provisions of Law No. 29733 —the Personal Data Protection Act—its Regulations approved by Supreme Decree No. 003-2013-JUS, and its supplementary and amending provisions (hereinafter, the “Personal Data Protection Regulations”), as well as the Information Security Directive issued by the competent authority.

III. PURPOSE OF PERSONAL DATA PROCESSING

Sphere IT Consulting processes the personal data of its employees, suppliers, customers, potential customers, and all individuals who have a legal or business relationship with the company, for the purpose of complying with applicable regulations, fulfilling the existing legal relationship, and safeguarding the security of its customers and employees.

The specific purposes of data processing include:

  • Providing IT consulting services, software development, and implementation of Commerce and Snowflake platforms.
  • Communicating with clients and responding to business inquiries.
  • Managing billing and payments.
  • Sending information about new services, events, and relevant content (with prior consent).

V. CONSENT

VI. TRANSFER OF PERSONAL DATA

Likewise, personal data may be transferred to:

  • Technology providers (hosting, data analytics, cloud platforms such as AWS, Google Cloud, and Microsoft Azure).
  • Authorized partners of Feedonomics and Makeswift for the execution of projects.
    Public entities legally authorized, within their jurisdiction, in compliance with applicable regulations or at their request (SUNAT, National Authority for the Protection of Personal Data, judicial authorities).
    International Transfers

Some providers and partners may be located outside of Peru, primarily in the United States and other countries. Sphere IT Consulting guarantees that such transfers are carried out with the appropriate safeguards, through standard contractual clauses or recognized international privacy certifications.

VII. SMS MESSAGES

Sphere IT Consulting may use the mobile phone number provided by the subscriber to send text messages (SMS) related to the services offered by the company, including confirmations, support, project coordination, reminders, and marketing communications, only with prior consent.

Sphere IT Consulting will not sell, rent, or share users’ personal information with third parties for marketing or promotional purposes. Likewise, mobile phone information, consent data for receiving SMS messages (SMS opt-in), and any information related to such consent will not be shared with third parties or affiliated companies for marketing or promotional purposes.

SMS messages will be sent solely for the purposes described in this Privacy Policy and in accordance with the consent granted by the user, in compliance with Law No. 29733—the Personal Data Protection Act, its Regulations, and other applicable regulations, as well as the regulations and standards required by U.S. telecommunications operators for business messaging services.

Messaging and data charges may apply, depending on your mobile carrier.

VIII. RETENTION PERIOD FOR PERSONAL DATA

Personal data will be retained and processed by Sphere IT Consulting only for as long as necessary to fulfill the purposes for which it was collected and/or until the data subject revokes their consent or requests its deletion.

Specific Retention Periods

  • Contractual data: for the duration of the contract and for up to 10 years thereafter, to comply with tax obligations under the Tax Code.
  • Data for marketing purposes: until the data subject withdraws their consent or requests deletion.
  • Browsing data: up to 24 months from the last visit to the website.

Once these retention periods have expired, the data will be securely deleted or anonymized.
